Monterey Peninsula Surgery Center – Applicant Privacy Policy (California Residents)

Monterey Peninsula Surgery Center, LLC (“MPSC,” “we,” “us,” or “our”) is committed to protecting the privacy of individuals who apply for employment with us. This Applicant Privacy Policy explains how we collect, use, and disclose personal information about job applicants and describes the rights that California residents have under applicable privacy laws, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).
This notice applies only to personal information collected from job applicants and candidates seeking employment with MPSC. It does not apply to current or former employees, independent contractors, patients, or website visitors outside the application process.

MPSC does not sell personal information or share it with third parties for cross-context behavioral advertising.
We only disclose applicant personal information to trusted service providers who perform services on our behalf and underwritten contracts that restrict them from using the information for any purpose other than assisting us with recruiting, hiring, or compliance.
2. Sources of Personal Information
We may obtain personal information from the following sources:
- Directly from you (e.g., application forms, resumes, interviews).
- From third parties that you authorize (e.g., background check companies, educational institutions, professional references).
- Automatically through our online applicant tracking system (e.g., cookies or device data).
3. How We Use Applicant Personal Information
MPSC collects and uses applicant information for the following purposes:
- To identify, evaluate, and communicate with applicants.
- To process and verify information in job applications.
- To perform background checks and employment verifications.
- To comply with federal, state, and local employment laws and recordkeeping requirements.
- To manage internal hiring operations and maintain applicant records.
- To respond to lawful requests and legal obligations.
MPSC will not use applicant personal information for any purpose that is incompatible with these uses or not permitted by law.
4. Your Rights Under California Law
If you are a California resident, you have the following rights regarding your personal information, subject to applicable legal exceptions:
- Right to Know / Access: You may request information about the categories and specific pieces of personal information we have collected about you.
- Right to Delete: You may request that we delete personal information we collected from you, subject to legal and operational exceptions.
- Right to Correct: You may request that we correct inaccurate personal information about you.
- Right to Limit Use of Sensitive Personal Information: You may request that we limit our use or disclosure of sensitive personal information to what is necessary for recruitment or legal compliance.
- Right to Non-Discrimination: We will not discriminate or retaliate against you for exercising your privacy rights.
Because MPSC does not sell or share applicant personal information for cross-context advertising, the right to opt-out of sale or sharing does not apply.
5. How to Exercise Your Rights
You may submit a request to know, delete, or correct your information using the following methods:

When submitting a request, please include your name, contact information, and the nature of your request (e.g., “Request to Delete Applicant Data”). We may require reasonable verification of your identity before processing your request.
We will respond within the time periods required by California law (generally 45 days, with possible extension of an additional 45 days).
6. Data Retention and Security
MPSC retains applicant personal information only as long as necessary to fulfill the purposes outlined in this Policy or as required by law. This may include retaining data for compliance, legal, and audit purposes.
We maintain appropriate technical, administrative, and physical safeguards to protect applicant personal information against unauthorized access, disclosure, or misuse.
When personal information is no longer needed, we securely delete or anonymize it in accordance with our data retention policy.
7. Third-Party Service Providers
MPSC engages service providers such as applicant tracking platforms, background check vendors, and cloud storage providers. These third parties are contractually required to maintain the confidentiality and security of personal information and may not use it for any purpose other than assisting with MPSC’s recruitment or hiring activities.
MPSC does not sell personal information to any third parties and does not authorize its service providers to sell or use applicant data for their own marketing or advertising purposes.
8. Updates to This Policy
We may update this Applicant Privacy Policy from time to time to reflect changes in our practices or applicable law. Updated versions will be posted with a new effective date.
Material changes will be communicated directly to applicants when required by law.
